On August 24, 2018, the New York State Division of Human Rights (“NYSHRL”) and the New York Department of Labor (“NYSDOL”) issued their long-awaited proposed model anti-sexual harassment policy and model anti-sexual harassment training program, which can be found here. As set forth in our prior blog, every New York State employer must promptly adopt and distribute an anti-sexual harassment policy to all employees. It is suggested that employers now review their current policies to ascertain whether they provide the same or greater protections than those published by the NYSHRL and NYSDOL. If not, employers should revise their policies based on the new proposed models. As well, as previously noted, all New York State employers must also conduct and provide anti-sexual harassment training for all employees prior to January 1, 2019.
